Certain Dodge Ram and Jeep Grand Cherokee cars are fitted with an optional air suspension system, which is touted as a luxury enhancement, but which, according to some reports, does not function when temperatures dip below freezing degrees. Because of this malfunctioning air suspension system, the Dodge Ram class action lawsuit Canada claims that owners of impacted cars have been forced to spend time, effort, and money in order to have the air suspension system replaced on their vehicles.
What is the Alleged Air Suspension System Defect?
According to reports, the Air Suspension 4-Corner is advertised as a luxury addition, and vehicles equipped with this feature are offered at a higher price. Air suspension systems, according to the Dodge Ram class action lawsuit Canada, work with the help of a compressor; however, the compressor is said to have failed as a result of condensation, dampness or moisture, which causes the internal valves to jam, resulting in the blowing of control fuse. A class action lawsuit against Dodge Ram was filed on behalf of the plaintiff, Christopher Heard, and a proposed class of persons or corporations in Canada who purchased one of the following model year 2013-2020 vehicles with the optional Air Suspension 4-Corner 9: the Jeep Grand Cherokee; the Dodge Ram 1500; and the Dodge Ram Rebel.
Christopher says that if he had known about the problem in the air suspension system when he acquired the car in 2016, he would either have avoided purchasing the vehicle or paid a lower price for it.
In the end, he claims he had to sell his Dodge Ram 1500 at a loss.
It is claimed in the Dodge Ram class action lawsuit that the plaintiffs ‘purchased and/or leased vehicles that are of a lower standard, grade, and quality than represented,’ and that they ‘did not receive vehicles that met ordinary and reasonable consumer expectations regarding safe and reliable operation.’ Fiat Chrysler Automobiles NV, Fiat Chrysler Automobiles US LLC, FCA Canada Inc., WOCO Tech USA Inc., and Mopar Canada are among the companies listed as defendants in the Dodge Ram class action lawsuit against the company.
WOCO reportedly produced the allegedly faulty air suspension parts, and Mopar allegedly entered into a distribution agreement with WOCO to deliver the parts to Dodge dealerships in Canada for installation in Class cars.
Defendants Allegedly Concealed Air Suspension System Defect
Christopher asserts that the defendants were aware of the air suspension problem as soon as it was first installed in the 2013 versions of the Class Cars since a number of vehicles returned with complaints that the air suspension system had failed within a short period of time. They did not, however, issue a recall for the fault because ‘the defect does not cause an easily detectable loss or failure of the Air Suspension system until it is run for lengthy periods of time in a colder temperature,’ as stated by the company in their report.
According to Christopher, if the defendants had conducted proper testing of the air suspension system, they would have discovered that it was more prone to failure in colder climes and should have made modifications to the system to prevent such failures.
In the Dodge Ram class action complaint, the plaintiffs claim that ‘since so many Affected Vehicles are located in colder climes, certain users, operators, owners, or lessors have encountered severe delay and wait time for a specific dealership to locate and procure replacement components.’ In certain situations, Class Members may have experienced a loss of control of their cars as a consequence of the air suspension system flaw, resulting in property damage and personal injury, which in turn may have led in an increase in their insurance premiums.
